If you are an employee who has a “protected characteristic” an employer must not discriminate against you because or as a result of that protected characteristic. Under the Equality Act there are 9 “protected characteristics”, these are:
- Gender Reassignment
- Being married or in a civil partnership
- Pregnancy or Maternity
- Religion and belief
- Sexual Orientation
Unlike unfair dismissal claims there is no minimum length of service requirement, which means you have protection even at interview stage. However, it is important to bear in mind that the Employment Tribunal has time limits for bringing such claims, and whilst there is some exceptions, these time limits are strict. You do not have to terminate your employment to submit a claim for discrimination, but can submit a claim whilst your employment is continuing.
