It is important at the commencement of employment of a key individual to for employers to take steps to protect their legitimate business interests. However, it is essential that any restrictive covenants are drafted so that they are both relevant and necessary. If the restrictive covenants are drafted too widely, it is likely that a Court will apply what is called the ‘blue pencil’ principal and render the covenants unenforceable.
